This State Law Privacy Notice (“Notice”) supplements our primary Privacy Policy and applies solely to residents of states with comprehensive state privacy legislation, including California, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Nevada, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia (collectively, “Applicable State Privacy Laws”). Capitalized terms used but not defined in this Notice shall have the meanings set forth in our Privacy Policy.

This Notice covers personal information collected through this website (the “Site”) and our related digital platforms and quote-matching services (collectively, the “Services”), which are owned and operated by Burke Digital LLC (“Burke,” “we,” “us,” or “our”).

This Notice provides mandatory disclosures under applicable state privacy frameworks, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).

1. Categories of Personal Data Collected, Disclosed, and Sold/Shared

The following table details the categories of personal information we have collected from and about consumers in the past twelve (12) months, the categories of third parties to whom we disclosed each category for a business purpose, and the categories of third parties to or with whom we have “sold” or “shared” each category (as defined under Applicable State Privacy Laws).

We collect personal data directly from you when you complete intake forms or speak with us on the phone, automatically via cookies, pixels, and tracking technologies when you navigate our Site, and from third-party sources, including marketing partners, analytics providers, lead aggregators, and other Network Partners.

2. Business Purposes and Targeted Advertising Disclosures

We collect, use, and disclose your personal data for the following specific business and commercial purposes:

• Providing the Services: Operating, maintaining, supporting, and providing our online quote-matching services and connecting or matching your submissions with our Network Partners (including lead buyers, participating carriers, agents, brokers, and aggregators).
• Targeted Advertising & Cross-Context Behavioral Advertising: Serving interest-based advertising across non-affiliated websites, profiling consumer preferences, and measuring advertising campaign performance.
• Direct Marketing & Communication: Communicating with you via phone, automated dialers, SMS, email, and direct mail regarding requested quotes, administrative updates, or promotional offerings.
• Research & Analytics: Analyzing usage trends, interaction metrics, and consumer preferences to improve features, our Site, and overall platform functionality.
• Security, Fraud Prevention & Legal Compliance: Monitoring system security, detecting and preventing unauthorized transactions or illegal activity, complying with legal processes, and conducting required internal Data Protection Assessments (DPAs) or compliance audits.
• Business Transactions: Supporting general corporate administration, asset sales, mergers, acquisitions, corporate reorganizations, or bankruptcy proceedings.

3. Targeted Advertising Restrictions and Protection of Minors

Opt-Out Right: You have the right to direct us to stop processing your personal data for targeted advertising, cross-context behavioral advertising, profiling, or transferring your personal data to Network Partners and third parties for such purposes.

Protections for Minors: As stated in our Terms of Use and Privacy Policy, our Site and Services are intended solely for individuals who are at least 18 years of age. We do not knowingly sell, share, or process for targeted advertising the personal data of consumers under 18 years of age. If we learn that a minor under 18 has submitted personal data through our Site, we automatically suppress that data from targeted advertising scripts, data shares, and transfers to Network Partners.

4. Sensitive Personal Data

We may collect certain categories of Sensitive Personal Information (“SPI”) as defined under Applicable State Privacy Laws, including information submitted in connection with online quote requests and intake forms.

Categories of Sensitive Personal Information Collected

To the extent collected, categories of Sensitive Personal Information may include:

• Government-issued identifiers (such as Social Security numbers, driver's license numbers, or state identification numbers);
• Financial account information;
• Information provided by consumers relating to product, service, or policy eligibility; and
• Other information classified as sensitive under Applicable State Privacy Laws.

Purposes for Processing Sensitive Personal Information

We process Sensitive Personal Information solely:

• To perform, maintain, and deliver our online quote-matching services and connect your submissions with requested Network Partners;
• To verify identity, authenticate requests, and prevent fraud;
• To comply with applicable legal, regulatory, and reporting obligations;
• To maintain system security, operational integrity, and user safety; and
• For other administrative purposes expressly permitted under Applicable State Privacy Laws.

We do not use Sensitive Personal Information to infer characteristics about consumers or for targeted advertising purposes unless expressly authorized by the consumer or permitted by law.

Right to Limit Use of Sensitive Personal Information

California residents have the right to direct us to limit the use and disclosure of Sensitive Personal Information to those business uses authorized under the CCPA/CPRA. Where applicable, instructions for submitting a request to limit the use of SPI are available through our Privacy Center.

Consent for Sensitive Personal Information

Where required by applicable law, we obtain appropriate consent prior to collecting or processing Sensitive Personal Information.

Opt-In Consent Requirements (e.g., CT, DE, IN, KY, MD, MN, MT, NE, NH, NJ, OR, TN, VA)

Where required under Applicable State Privacy Laws, we obtain your affirmative, opt-in consent prior to collecting or processing Sensitive Personal Information. You may revoke your consent at any time by visiting our Privacy Center.

5. Data Retention

We retain personal information only for as long as reasonably necessary and proportionate to fulfill the purposes described in this Notice and our Privacy Policy (including providing the Services and connecting you with Network Partners), unless a longer retention period is required or permitted by law.

Retention periods vary depending upon:

• The category and sensitivity of the personal information;
• The nature of our ongoing relationship with the consumer;
• Applicable legal, regulatory, tax, accounting, litigation, and statutory compliance requirements;
• Operational integrity and fraud-prevention requirements; and
• Whether retention is necessary to establish, exercise, or defend legal claims.

Different categories of personal information may be subject to different retention periods based on these criteria.

6. Summary of Your Statutory Privacy Rights

Depending on your state of residence, Applicable State Privacy Laws may provide you with specific statutory rights regarding your personal information:

• Right to Confirm and Access: The right to confirm whether we are processing your personal data, access such data, and receive a portable copy of the specific pieces of personal information collected about you.
• Right to Know Categories and Recipients: The right to request information regarding:
  • Categories of personal information collected, sold, shared, or disclosed;
  • Categories of sources from which information was collected;
  • Business or commercial purposes for collecting, selling, or sharing information; and
  • Categories of third parties and Network Partners to whom personal information was disclosed, sold, or shared (or specific third parties where required by law, such as in Oregon).
• Right to Delete: The right to request deletion of personal information collected directly from or about you, subject to certain statutory exceptions (e.g., legal compliance, fraud prevention, completing transactions).
• Right to Correct: The right to request correction of inaccurate personal data maintained about you, taking into account the nature of the data and the purposes of processing.
• Right to Opt Out of Sale, Sharing, or Targeted Advertising: The right to direct us not to:
  • “Sell” your personal data;
  • “Share” your personal data for cross-context behavioral advertising; or
  • Process your personal data for targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects.
• Right to Limit Use of Sensitive Personal Information: The right (where applicable, such as in California) to direct us to limit the use and disclosure of Sensitive Personal Information to those mandatory business operations permitted under applicable law.
• Right to Revoke Consent: The right (where applicable under state law) to withdraw previously granted opt-in consent for the processing of Sensitive Personal Information.
• Right to Non-Discrimination: We will not discriminate or retaliate against you for exercising any of your statutory privacy rights (e.g., by denying Services, charging different prices, or providing a different level or quality of Services).

Exercising Access, Correction, Deletion, and Other Statutory Rights

To exercise your rights to Access, Confirm Processing, Delete, Correct, or Limit the Use of Sensitive Personal Information:

Identity Verification Process

To protect consumer privacy and security, we verify your identity before fulfilling substantive access, deletion, or correction requests. We may verify your identity by matching up to three data points provided in your request against data maintained in our systems. If we cannot verify your identity to the required degree of certainty, we may decline the request and will notify you accordingly. (Note: Identity verification is not required for standard opt-out of sale/sharing requests unless fraud is suspected.)

Universal Opt-Out Preference Signals

Where required by applicable law, we recognize and honor browser-based opt-out preference signals, including the Global Privacy Control (GPC) and other legally recognized universal opt-out mechanisms. When our systems detect an opt-out preference signal, we treat it as a valid request to opt out of the sale or sharing of personal information and processing for targeted advertising for that specific browser or device.

Authorized Agents

You may designate an authorized agent to submit requests on your behalf. To process a request from an authorized agent, we require proof of written permission (such as a signed authorization or a valid power of attorney) and may still verify your identity directly with you unless the agent holds a formal power of attorney pursuant to applicable state law.

8. Appeals Process

If we decline to take action on a statutory privacy rights request, you have the right to appeal our decision within a reasonable time following receipt of our denial.

How to Submit an Appeal: You may submit an appeal through our Privacy Center or by sending a written request to our Data Privacy Officer. Please include the subject line “Privacy Rights Appeal,” reference your initial request reference number, and explain the basis for your appeal.

Appeal Resolution: We will respond to your appeal in writing within forty-five (45) calendar days of receipt (or such other timeframe mandated by Applicable State Privacy Laws). Our response will explain the reasons for our decision.

Escalation to Attorney General: If your appeal is denied, we will provide you with an online mechanism or contact details to file a complaint with your State Attorney General, including:

9. California “Shine the Light” Disclosures

Pursuant to California Civil Code Section 1798.83, California residents may request information once per calendar year regarding categories of personal information disclosed to third parties for those third parties' direct marketing purposes during the preceding calendar year.

Requests may be submitted through our Privacy Center using the subject line “California Shine the Light Request.”

10. Changes to This Notice

We may update this Notice from time to time to reflect changes in our information handling and privacy practices and/or changes in Applicable State Privacy Laws. The “Last Updated” date at the top of this page indicates when this Notice was last revised.

If we make changes, we will revise the date at the top of this page and, in the case of material changes, we will provide you with additional notice as required by applicable law (such as through prominent notices on our Site or direct electronic communication). Unless otherwise stated, the current version of this Notice applies to all Services, our Site, and all personal information under our control.
